How can I protect myself from liability?
I am soon to start teaching a small group of children (6-7) Chinese Wushu (a performance variant of Chinese martial arts). I have plenty of teaching experience, however this is my first time teaching outside of an established school. It’s a fairly casual affair, but I would still like to protect myself from any liability suits by having each parent sign a standard waiver. I’ve found many waiver forms online that I figure I can adjust the wording to, but how effective are these? What is the best way to protect myself without going through the costly and time-consuming process of having a lawyer put together a waiver/contract? I’m certainly not going to have these kids doing anything dangerous, but there is inherent risk in any physical activity…and I know that many people are still sue-happy.
In terms of the waiver, it is best that you consult an attorney. A good attorney should be able to draw up a good waiver in an hour which should run you about $175 to $250. I think that it would be money well spent if it avoids a lawsuit. Even though the Martial Arts Teachers Association (MATA) also has release forms available for their members and membership is very affordable. In addition to a good waiver you also need to purchase a Commercial General Liability Insurance Policy since no matter how good a waiver or release you have it will not guarantee that you won’t be sued or that if you are sued that you won’t be held liable. There are CGL policies that are specifically tailored for martial art studios and/or teachers. You can consult a local independent agent for assistance and/or also check with MATA since they might have an association sponsored policy or be able to give you a local referral.
